$150,000 Jury Verdict Returned in Police Misconduct Case

Chicago, IL (Law Firm Newswire) February 23, 2023 – Hale & Moinco announced that attorneys Shawn Barnett and Jason Marx, assisted by paralegal Jessica Dugan, secured a $150,000 jury verdict in their client’s favor in federal court in the Eastern District of Wisconsin.

The firm’s client was an unarmed man shot three times in the back by a law enforcement officer as he attempted to surrender. Attorneys Barnett and Marx argued that the defendant officer’s use of deadly force was excessive and violated the plaintiff’s rights under the Fourth Amendment.

The defendant officer claimed that he believed the plaintiff had a weapon in his possession and posed a danger to other officers. Several other officers testified they also thought the plaintiff might have been armed.

Attorneys Barnett and Marx pointed out to the jury inconsistencies in the officers’ testimony and that all the other evidence clearly showed the plaintiff was unarmed during the entire encounter.

Persuaded by their arguments, the jury rejected the officers’ version of events and returned this favorable verdict on February 7, 2023, after only two hours of deliberation.
